Banking
Harding Richards Lawyers has developed an extensive banking practice having acted for a number of Australian banks and regularly advises borrowers about bank documentation.
We advise on more complicated transactions such as project financing and acquisition financing. The Partners have acted in a variety of default situations. We consider our experience in acting in default situations makes us more alive to issues that must be addressed in preparing loan documentation.
Bankruptcy/Insolvency
We have experience in all aspects of insolvency law including bankruptcy, winding up of companies, receivership, voluntary administration and litigation related insolvency issues.
In addition to administration and winding up of companies, we deal with a wide range of matters pertaining to the financial health of companies. In many instances this involves advising clients who have financial exposure to a company or individual. We also advise companies on insolvent trading and the duties and responsibilities of directors of companies in financial difficulties.
Our debt recovery and security enforcement work includes advising secured creditors on the realisation of the security, options for security enforcement, and rights against guarantors and other parties.
Commercial
We assist clients with general advice on a whole range of commercial transactions. We have experience in the purchase, sale and merger of businesses and assets, including all associated statutory and licensing requirements. We also have experience in special business arrangements such as franchising, licensing and distribution agreements.
Conveyancing
We can assist with all types of conveyances. We will review the contract before you sign and advise you of any negative terms or conditions. When we have received the signed contract we will undertake all aspects of a conveyance including conducting searches, preparation of documents, negotiating with financiers and attending settlement.
Court Work
The Court work which the firm handles is varied but principally revolves around commercial transactions. We are mindful of our clients’ commercial objectives and make every attempt to resolve disputes quickly and economically.
Family Law
The ending of a marriage or de facto relationship can be a very difficult and stressful period.
We offer clients advice and support at this sensitive time to secure an outcome that is fair and equitable.
As we practice in property law, business law and estate planning we are able to draw on our knowledge of these areas of law when assisting a client in family law matters.
Leasing
We assist landlords and tenants on all aspects of commercial industrial and retail shop leasing. We assist landlords in the drafting and preparation of leases. We advise tenants as to their rights and obligations under their lease and assist in the negotiation process prior to the leases being executed.
